§ 3-110. Establishments operated under licenses issued and outstanding pursuant to prior ordinances; currently outstanding licenses; exceptions for prior establishments.

  • (a)

    All licenses issued by the city for the sale of beer and/or which are outstanding on January 1, 2003, the effective date of this chapter, shall continue in effect until they expire according to the terms of such licenses. Upon the expiration of such licenses, new renewal licenses must be obtained pursuant to the terms of this chapter. Establishments operating under such currently issued licenses shall be operated after January 1, 2003, the effective date of this chapter, in accordance with all of the applicable requirements of this chapter.

    (b)

    No holder of a license to sell beer and/or wine in the city, either for on-premises consumption or in packages for off-premises consumption, issued pursuant to any ordinance which preceded this chapter, which license was in effect on January 1, 2003, the effective date of this chapter, actually operating a business pursuant to such license shall be denied a license for the same type and scope of operations as were being carried on at such date due to the fact that such business does not qualify as an eating establishment, hotel, indoor commercial recreational establishment or private club.
