§ 201. General.

  • The owner of any land lying within the area of jurisdiction of these regulations who wishes to subdivide such land shall seek approval by the planning commission according to the following procedure:

    A.

    Informal consultation: The subdivider should consult early and informally with the planning commission (or a designated representative of the planning commission) for advice and assistance prior to submitting any plat. The subdivider should submit sketch plans and data showing existing conditions within the site and in its vicinity

    and the proposed layout and development of the subdivision. No fee shall be charged for this informal consultation and no formal application shall be required.

    B.

    Submission of preliminary plat: Prior to making any street improvements or installing any utilities, the prospective subdivider shall submit to the planning commission a preliminary plat as specified in section 202 of this article. Where circumstances warrant, the planning commission may modify the herein contained requirements in accordance with section 402 of Article IV. Approval of the preliminary plat by the planning commission constitutes authorization for the subdivider to develop the subdivision subject to the minimum standards for improvements prescribed in Article IV, and the minimum standards of design prescribed in Article III.

    C.

    Submission of final plat: After approval of the preliminary plat, the subdivider may proceed with the preparation of the final plat and other documents as may be required in connection therewith. No final plat shall be approved by the planning commission until either:

    1.

    The required improvements listed are constructed in satisfactory manner and approved by the local approving authority or agent, or

    2.

    In lieu of such prior construction, the planning commission has received written notification from the City Attorney that the mayor and city council has accepted an approved bond, or security in the amount equal to the estimated cost of installation and completion of the required improvements, whereby improvements may be made and utilities installed without cost to the city in the event of default by the subdivider.

    D.

    Submission of plat of record: Upon approval of a final plat, the subdivider shall submit to the planning commission for its approval a plat of record prepared in accordance with section 204 of this article.
